Agriculture Law
Agriculture law considers the role of government in agriculture as well as
traditional transaction issues such as leasing, the marketing and storing of
commodities, special secured financing rules relating to agriculture credit,
and issues confronting the livestock industry.
Agriculture law also includes legal issues related to the commercial activities
of soil preparation, seed planting, crop harvesting, gardening, horticulture,
viticulture, dairying, poultry, and ranching. There are many, complex federal
and state regulation governing these activities and their impact on farmers,
farm workers, consumers, and the environment.
Agricultural lawyers provide legal council on all aspects of the agricultural
and livestock business.
The Packers and Stockyard Act is a competition, trade practice, and financial
protection law. The purpose of the law is to maintain effective trade competition
and fair trade practices in the livestock, meat, and poultry marketing. It also
protects these industries from unfair trade practices and monopolistic practices
of competitors. The Packers and Stockyard Act further protects consumers against
unfair business practices in the marketing of meats and against restrictions
on competition which might raise the price of meats.
The Migrant and Seasonal Agricultural Worker Protection Act (MSPA) is designed
to provide migrant and seasonal farm workers with protections concerning pay,
working conditions, and work-related conditions, to require farm labor contractors
to register with the U.S. Department of Labor, and to assure necessary protections
for farm workers, agricultural associations, and agricultural employers.
