abandonment of a child - The failure of a parent or a guardian to provide any financial assistance to or communicate with a child over a period of time. When this happens, a court may consider the child abandoned by the parent or guardian and order that person's rights terminated. Abandonment also describes situations in which a child is physically abandoned.  

common law marriage - A type of marriage, recognized in some states, in which couples can become legally married, in the absence of compliance with legal formalities, by living together for a long period of time, holding themselves out as a married couple and intending to be married.  

community property - All property acquired by the joint efforts of a husband and wife during their marriage.  

consanguinity - The relationship of "blood relatives." Individuals that have a common ancestor.  

dissolution - The termination of a legally defined relationship.  

durable power of attorney - A power of attorney that remains in effect in the event that the principal becomes incapacitated.  

durable power of attorney for finances - A document in which you give someone the legal authority to manage your financial affairs in the event that you become incapacitated  

durable power of attorney for healthcare - A document in which you name someone who has the authority to make medical decisions for you if you are unable to make those decisions yourself.  

Equity - Justice administered according to fairness; the spirit or habit of fairness in dealing with other persons.

Family and Medical Leave Act (FMLA) - Federal law requiring employers with 50 or more employees to provide each employee with 12 weeks of unpaid leave during a year's time for the birth of a child, family health needs or illness.  

family court - Division of a court that considers only cases having to do with family

Family Law - Those areas of the law pertaining to families, i.e., marriage, divorce, child custody, juvenile, paternity, etc.

guardian - An adult who has been appointed by a court to control and care for a minor and his property.  

guardian ad litem - A person appointed by a court to represent and protect the interests of a child or an incapacitated adult during a lawsuit.  

guardianship - A legal relationship created by a court where an adult is appointed as the guardian of a minor child or an incapacitated adult.  

head of household - Person who supports and maintains, in one household, one or more people who are closely related to him by blood, marriage or adoption.  

marriage - The legal recognition of a union between two individuals.  

marriage certificate - A legal record that provides proof of a marriage, usually issued to the married couple by the state or county clerk's office.  

marriage license - A legal record that permits two individuals to get married  

Next Friend - One acting without formal appointment as guardian for the benefit of an infant, a person of unsound mind not judicially declared incompetent, or other person under some disability.

next of kin - Closest relative of someone who has died. Usually the spouse is considered the "next of kin".  

paternity suit - An action brought to determine the identity of the father of a child born out of wedlock, and to provide for the support of the child once the identity of the father has been determined.  

power of attorney - Document that gives another person legal authority to act on another's behalf.  

premarital agreement - Agreement made by a couple prior to marriage that controls distribution of assets in the event of a divorce.
